The Adopted Regulations Index provides a list of existing rules and/or regulations that departments are required to administer. These requirements address various matters of public interest such as health, safety and environmental effects. These documents are provided in an effort to promote a transparent and open process to all interested parties with regard to regulatory reform.

Text amendment to Maricopa County Zoning Ordinance - Amend Chapter 5, Section 501 Rural-190 Zoning District, Article 501.5.4 Maximum Lot Coverage, and Section 502 Rural-70 Zoning District, Article 502.5.4 Maximum Lot Coverage of the Maricopa County Zoning Ordinance - to increase the respective Maximum Lot Coverage permitted in each zoning district. It was approved by the Board of Supervisors on November 1, 2023 and took effect 30 days later.

Text Amendment to the Maricopa County Local Additions & Addenda to adopt and amend the following construction safety codes: 2018 International Building Code, 2018 International Residential Code, 2018 International Plumbing Code, 2018 International Mechanical Code, 2018 International Fuel Gas Code, 2018 International Green Code (voluntary), 2018 International Energy Conservation Code (voluntary), 2018 International Existing Building Code, and 2017 National Electric Code.  These codes with amendments become effective 30 days after BOS approval with a grace period through 30 December 2022 before mandating new codes. It was approved by the BOS on 8/17/22 and took effect 30 days later.

TA2019001 - Wireless Communication Facilities (WCF) A text amendment to the Maricopa County Zoning Ordinance, Sections 1202 & 1303, to streamline WCF permitting and to bring the ordinance into alignment with federal rules It deleted requirement for a Conditional Use Permit for a WCF consistent with ordinance requirements and added language regarding qualifying eligible facilities for colocation. This is a lessening of regulatory burden. It was approved by the BOS on 10/7/20 and took effect 30 days later.

TA2019002 - Variance Timeframe - A text amendment to the Maricopa County Zoning Ordinance, Section 303, deleting the mandate for construction permitting related to variances to be initiated within 120 days. The idea being that warrant for a parcel to receive a condition will almost always be a condition that exists in perpetuity and not usually a temporal condition necessitating timely construction. This is a lessening of regulatory burden. It was approved by the BOS on 10/7/20 and took effect 30 days later.

TA2019003 - Home Based Business - A text amendment to the Maricopa County Zoning Ordinance, Sections 501 & 601, further liberalizing regulation and fostering home bases businesses. It brings the ordinance in alignment with recent changes to state law allowing non-resident employees at a home-based business. This is a lessening of regulatory burden. It was approved by the BOS on 10/7/20 and took effect 30 days later.

TA2015004 - Accessory Recreational Structures - A text amendment to the MCZO, Articles 501.2 & 601.2, accessory recreational structures in the Rural and Single-Family Residential zoning districts. Increased the maximum height of accessory recreational structures and clarification that both tennis courts and other accessory recreational structures are permitted.

TA2014001 - Wireless Communication Facilities - A text amendment to the MCZO, Chapter 2, Chapters 12 and 13. The purpose of the amendment was to streamline entitlement process for WCFs. The amendment also eliminated the WCF Use District, promoting co-location an existing vertical structures and fostering moderate height and slim monopole designs that would be permitted by right.

TA2014009 - Gates (Zoning) - A text amendment to the MCZO, Chapter 15, Article 1504.5.2, this amendment eliminated the requirement to obtain a zoning clearance for gates within streets and road easements.

TA2014008 - Property Maintenance - A text amendment to the MCZO, Chapter 2 and Chapter 11, Article 1116, added a new Article Property Maintenance and definitions. This article and definition were derived from Maricopa County Ordinance No. P-10 (Abatement). Incorporation into the MCZO will provide civil enforcement process and will forego the need for formal abatement proceedings for simple items.

TA2014005 - Billboard SUP - A text amendment to the MCZO, Chapter 13 Article 1301.1.41.1. Amendment included clarifying language that a billboard may be relocated by Special Use Permit due to public acquisition of from a parcel located within the perimeter boundary of Maricopa County.

TA2014004 - R-5 Use Regulations - A text amendment to the MCZO, Chapter 7 Article 702.2 Use Regulations, included new articles 702.2.5 & 702.5.6 and renumber existing 702.2.5 and 702.2.7. The new articles state that all uses permitted in the C-2 Neighborhood Commercial Zoning District and Mobile Home Parks shall be permitted in the R-5 Multi-Family Residential Zoning District.

TA2014003 - C-3 Use Regulations - A text amendment to the MCZO, Chapter 8 Article 803.2 Use Regulations, included new article 803.2.44 and renumber sub-articles. All uses permitted in the R-5 Multi-Family Residential Zoning District are also permitted in the C-1 Neighborhood Commercial Zoning District.

Addressing Regulations (PDF)Maricopa County enforces addressing regulations to provide a uniform means of identifying developed property and its improvements for the provision of emergency services, government record keeping, and postal delivery. Primary consideration to the needs of emergency service providers shall always be given by the Address Official when assigning/changing any address.
6/10/2015Drainage Regulations, Section 1205 of the Zoning Ordinance (PDF)The Planning and Development department regulates drainage of all land within the unincorporated areas of Maricopa County to promote and protect the health, peace, safety, comfort, convenience and general welfare of county residents. The Drainage Regulations apply to all development of land and conditions that may affect drainage systems and patterns. The Planning and Development Department administers the regulations and coordinates with other agencies to ensure that new development does not increase runoff, divert flows or back water onto other properties.

Subdivision (PDF)The purpose of Maricopa County's Subdivision Regulations is to provide for the orderly growth and harmonious development of the County; to insure adequate traffic circulation through coordinated street systems with relation to major thoroughfares, adjoining subdivisions and public facilities; to achieve individual property lots of reasonable utility and livability; to secure adequate provisions for water supply, power, drainage, protection against flood, storm water retention/detention, sanitary sewerage; paved streets and other accesses; and other health and safety requirements; to consider adequate sites for schools, recreation areas, and other public facilities; to promote the conveyance of land by accurate legal description; and to provide practical procedures for the achievement of this purpose.

P-30 April 24, 2014 Licensing Time Frames Ordinance (PDF) The purpose of this ordinance is to establish time frames for Administrative Completeness Review and Substantive Review for all licenses issued by regulatory departments and agencies of Maricopa County in compliance with A.R.S. 11-1601 through A.R.S. 11-1605.

Noise (PDF) At and above certain levels, noise is detrimental to the health and welfare of Maricopa County citizens. Therefore, Maricopa County has determined that it is in the best interest of its citizens to control noise in a manner which promotes commerce; the use, value, and enjoyment of property; sleep and repose; and environmental quality. Therefore, it is hereby declared to be the policy of Maricopa County to prohibit excessive, unnecessary, disruptive, and annoying noises from all sources. The Sheriff's Department is responsible for enforcement of the Maricopa County Noise Ordinance. Either contact the Sheriff's at 602-876-1000 or contact the substation in your area.
